When he was just 17 years old, he joined the United States Air Force and was stationed at Minot Air Force Base in Minot, North Dakota, where he served as a security policeman.

While in the military, he attended Minot State University and Central Texas College.

However, in 1999, Payne faced a complaint by the SEC over eight instances where his firm recommended purchasing members' stock through recorded messages, without disclosing that he received payments from members to promote their stock.

Payne settled with the SEC by agreeing to a permanent injunction against violating Section 17(b) of the Securities Act of 1933 and paying a civil penalty of $25,000. Payne's first book, Be Smart, Act Fast, Get Rich: Your Game Plan for Getting It Right in the Stock Market was published in 2007. Additionally, he has made appearances on C-SPAN.
